When it comes to packaging in Colorado, which was one of the first two states to legalize use recreationally they have specific regulations that distributors must follow in order to sell marijuana. The first packaging requirement has to do with complying with child-resistant standards. A child-resistant design must be difficult for children under five to open, but not difficult for adults to use properly. Next, packaging must be opaque, meaning that the product can not be seen through the packaging. Lastly, packaging must be resealable for products that are intended or contain multiple servings.

The next requirement for packaging is about what must be on the packaging in order for it to be sold recreationally. Colorado requires its new universal symbol to be on the front of all outer packages. This symbol can be downloaded here. Packaging must also include the statement “Contains Marijuana. Keep out of the reach of children.” That needs to be located directly below the symbol.

The following information pertains specifically to edible products in relation to the universal symbol. The universal symbol must be marked, stamped, or imprinted for each edible product per standardized serving (servings consist of 10 mg of THC). If unable to mark edible products, such as bulked goods or powders, the product must be packaged in single-serving, child resisted containers. If the edible product contains multiple servings, every single serving must be marked with a universal symbol. The universal symbol serves as a visual indication that the product contains marijuana helping both consumers and non-consumers alike to easily identify marijuana products.

Effective in 2016, packages may not include the words “candy” or “candies” unless it is part of the marijuana establishment’s name. Additionally, each container of retail marijuana must be labeled with the relevant and necessary information for consumers. This includes potency statements and contaminates testing statements. The information must be presented in a clear and noticeable format that is easily accessible to the consumer.
